Terms of Service

1. The Service

PromptCacheAI provides an API-based caching layer that allows developers to store and retrieve AI prompt/response workflows to reduce duplicate large language model (LLM) calls, improve speed, and reduce costs.

PromptCacheAI is provider-agnostic. You may use the Service alongside OpenAI, Anthropic, Google Gemini, self-hosted models, or other AI providers. PromptCacheAI does not generate AI outputs itself.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use PromptCacheAI. By using the Service, you represent that you have the legal authority to agree to these Terms.

3. Accounts and Access

To use PromptCacheAI, you must create an account and authenticate using an API key or other credentials. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.

You may not share, sell, or resell access credentials without authorization.

4. Cached Data and Customer Content

PromptCacheAI stores cached prompts and responses encrypted at rest. Cached entries are scoped to your account and namespaces.

You retain ownership of any prompts, responses, or other content you submit through the Service (“Customer Content”).

By using PromptCacheAI, you grant us a limited license to store, encrypt, process, and transmit Customer Content solely as necessary to provide and operate the Service.

You are solely responsible for the content you submit. You should not submit sensitive personal information, regulated data, or confidential content unless you have determined caching is appropriate for your use case.

PromptCacheAI does not monitor, review, or validate Customer Content and has no obligation to remove, restrict, or moderate Customer Content unless required by law.

5. Plan Limits and Rate Limiting

Use of PromptCacheAI may be subject to subscription plan limits, request quotas, namespace limits, and rate limiting. These limits are enforced to maintain service reliability and fair usage.

6. Prohibited Uses

You agree not to use PromptCacheAI to:

• Violate any applicable laws or regulations
• Store or distribute illegal, harmful, or abusive content
• Attempt unauthorized access or interfere with the Service
• Exploit the Service for spam, fraud, or abuse
• Use PromptCacheAI to store highly regulated personal data, including HIPAA- protected health information, PCI-regulated payment data, or government-issued identifiers.

7. Cache Availability

Cached responses may expire, be evicted, or become unavailable based on TTL settings, plan rules, or system maintenance. PromptCacheAI does not guarantee that cached entries will remain available indefinitely.

The Service may experience interruptions, delays, or downtime. We do not provide a service level agreement (SLA) unless explicitly agreed in writing, and we do not guarantee continuous or error-free operation.

We may remove, evict, or disable access to cached entries (including Customer Content) as necessary to enforce these Terms, comply with law, address security concerns, prevent abuse, or maintain service integrity.

PromptCacheAI does not guarantee the availability, persistence, or retention of any cached prompts, responses, or Customer Content, and will not be liable for any loss, deletion, corruption, or inability to retrieve such content for any reason.

8. Billing and Subscriptions

PromptCacheAI offers paid subscription plans. Billing is handled securely through Stripe. We do not store full payment card details.

You may cancel your subscription through Stripe at any time. Upon cancellation, access to paid features may continue until the end of your current billing period.

We do not provide refunds or credits for partial subscription periods, unused usage, or downgrades, except where required by law.

9. Suspension and Termination

We may suspend or terminate your access to the Service at any time if you violate these Terms, misuse the API, or create risk or harm to PromptCacheAI or others. We may also suspend or terminate access at our discretion, with or without notice, including for business, legal, or security reasons.

You may delete your PromptCacheAI account directly from the Settings dashboard. Account deletion is permanent and irreversible and will cancel any active subscription and remove all associated cached data, namespaces, API keys, and account records.

Subscription cancellation through Stripe stops billing but does not automatically delete stored data unless you complete full account deletion.

We may retain limited information where required to comply with legal, tax, or regulatory obligations.

9A. Data Retention and Survival

Upon account termination or deletion, PromptCacheAI will remove or render inaccessible your stored cached content, namespaces, and account records from active systems within a reasonable timeframe, except where retention is required for archival backups, to comply with applicable law, enforce our agreements, collect amounts owed, resolve disputes, or prevent fraud and abuse.

The following sections will survive any termination or deletion of your account: Customer Content obligations, prohibited uses, disclaimers, limitation of liability, indemnification, and governing law.

10. Disclaimer of Warranties

PromptCacheAI is provided on an “as is” and “as available” basis. We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

PromptCacheAI is not responsible for any loss, deletion, corruption, or unavailability of cached prompts, responses, or other Customer Content, including due to TTL expiration, system maintenance, service interruption, or account termination.

11. Responsibility for AI Outputs

PromptCacheAI does not generate AI responses and does not guarantee the accuracy, quality, or legality of content produced by your LLM providers. You are responsible for how cached responses are used in your applications.

12. Limitation of Liability

PromptCacheAI will not be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of data, profits, or business interruption.

Our total liability for any claim will not exceed the amount you paid us in the prior twelve (12) months.

13. Intellectual Property

PromptCacheAI retains all rights, title, and interest in and to the Service, including our software, APIs, documentation, branding, and trademarks. These Terms do not grant you any rights to use our intellectual property except as necessary to access and use the Service.

14. Indemnification

You agree to indemnify, defend, and hold harmless PromptCacheAI, its affiliates, officers, directors, employees, and agents from and against any claims, damages, liabilities, losses, and expenses (including attorneys’ fees) arising out of or related to:

• Your access to or use of the Service
• Your violation of these Terms or any applicable law
• Any prompts, responses, or other content submitted, stored, or transmitted through the Service (“Customer Content”)
• Any allegation that your Customer Content infringes or violates the rights of a third party
• Any misuse of cached outputs or AI-generated responses in your applications

PromptCacheAI is not responsible or liable for Customer Content, including any legal, regulatory, or third-party claims arising from content you choose to cache or retrieve using the Service.

15. Governing Law and Venue

These Terms are governed by the laws of the United States and the State of Virginia, without regard to conflict-of-law principles.

Any disputes arising under these Terms will be resolved exclusively in the state or federal courts located in Virginia, United States, and you consent to personal jurisdiction in such courts.

16. Force Majeure

PromptCacheAI is not liable for any delay or failure to perform due to events beyond our reasonable control, including natural disasters, third-party outages, internet failures, labor disputes, or government actions.

17. API Changes and Versioning

We may update, modify, or deprecate parts of the Service, including API endpoints and features. We do not guarantee that any endpoint or functionality will remain available indefinitely. Where practical, we may provide advance notice of material changes, including through documentation or the website.

18. Assignment

You may not assign or transfer these Terms (or your account or API credentials) without our prior written consent. We may assign these Terms in connection with a merger, acquisition, corporate reorganization, or sale of all or substantially all of our assets.

19. Entire Agreement; Severability; Waiver

These Terms (together with the Privacy Policy) constitute the entire agreement between you and PromptCacheAI regarding the Service and supersede any prior or contemporaneous agreements or understandings.

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any provision is not a waiver of our right to do so later.

20. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Continued use of the Service means you accept the updated Terms.
